SANTIAGO DE CHILE, 16 de abril de 2021.- El matemático e investigador chileno Leandro Shara, colaborador del Círculo de Periodistas Deportivos de su país y de AIPS América, nos escribe para comentarnos que la UEFA anuncia el uso de uno de sus formatos que el lo tiene debidamente protegido, de acuerdo con los convenios internacionales que cubren estas materias. Leandro, Presidente y CEO de MatchVision, ha dedicado más de 15 años de su vida a la investigación y desarrollo de estas soluciones matemáticas, que finalmente concluyen en un formato de competencia. Su declaración, incluida en un comunicado, es la siguiente:
“En cuanto a lo que se ha comentado ampliamente en las redes sociales y la prensa, que la UEFA anunciará el uso de un nuevo formato para la Liga de Campeones 2024, que es un uso no autorizado, pues es uno de los formatos de competición desarrollado por Leandro Shara y MatchVision (Formato de Zonas © en español; Pot System© en Inglés), comunicamos lo siguiente:
1. Varios comunicados de prensa, incluyendo Martyn Ziegler’s en The Times, han escrito sobre las propuestas para la «Sacudida de la Liga de Campeones de la UEFA», bajo el erróneamente llamado -Sistema Suizo-«, que con 32 o 36 equipos se jugarán 10 partidos en la primera fase, sin grupos, haciendo hincapié en la ventaja de la flexibilidad dada por el formato de Leandro Shara.
2. El verdadero «Sistema Suizo» se ha utilizado en ajedrez durante décadas, también es ampliamente utilizado hoy en día en eSport. Bajo el Sistema Suizo, el emparejamiento para cada ronda (o «fecha» en el fútbol) se basa en los resultados anteriores «resultados fecha a fecha», por lo que los competidores se enfrentarían en cada ronda a rivales de su mismo nivel, ganadores con ganadores, perdedores con perdedores.
3. De acuerdo con los comunicados de prensa, y las declaraciones de ECA, el formato propuesto no contiene las características del auténtico Sistema Suizo (lo que es falso), ya que no contempla ninguna clasificación intermedia, y determinación del Fixture basado en la clasificación, sino que tiene un emparejamiento predefinido previo al inicio del torneo, en diferentes zonas, tal como es el Formato de Zonas©.
4. En cambio, el formato propuesto es de hecho una implementación del Formato de Zonas© desarrollado, investigado, probado, registrado e implementado por Leandro Shara y MatchVision, esto, desde el año 2006. El sistema establece que los participantes se distribuyen en zonas, en función de la clasificación (o cualquier otro mecanismo), por lo que cada equipo juega un número predefinido de partidos contra rivales de cada zona .
5. El mayor beneficio del Sistema de Zonas© es la flexibilidad, ya que el número de zonas y partidos frente a los equipos de cada zona se puede ajustar, esto a cualquier número de equipos totales, partidos y jornadas requeridas. En 2014 publicamos un ejemplo escrito para las clasificatorias de la Euro, utilizando diferentes números de Zonas y jornadas.
6. El Presidente de la ECA, Sr. Andrea Agnelli, explicó que esa idea provino del CEO de Ajax, Edwin van der Sar, quien propuso este formato hace un año, bajo el nombre de «Swiss System». Más tarde se descubrió que fue el Asesor Estratégico de Ajax, Erik van Spanje, quien ofreció este formato, y lo llamó un «Sistema Suizo». El Sr. van Spanje, es un ex ejecutivo de la consultora holandesa Hypercube.
7. En febrero de 2016, MatchVision firmó un Acuerdo de Confidencialidad (NDA) con Hypercube, ya que dicha empresa quería conocer en detalle las soluciones de formato de MatchVision, y buscar oportunidades de negocio conjuntas. MatchVision compartió varios casos prácticos, y ejemplos de sus soluciones de formatos de torneos.
8. Meses más tarde, Hypercube, comenzó a ofrecer las soluciones de formato de propiedad de MatchVision a diversas federaciones deportivas, bajo el engañoso nombre de «Swiss System», sin nuestra aprobación, evidentemente eludiendo el hecho de que el Sistema de Zonas © fue compartido y explicado en detalle a Hypercube, por MatchVision. Esta fue la primera vez en la historia que un formato con Fixture predefinidos se llamó un «Sistema Suizo», y con el único propósito de engañar, y evitar el hecho de que el Sistema de Zonas© tiene derechos de protección intelectual en la República de Chile, sobre la base de la cual se aplican los Acuerdos Internacionales de Protección Intelectual mundial (el Sistema fue protegido inicialmente el 17demayode 2006, bajo el Número de Registro 154857, en Chile, y se complementó en 2012, bajo el Número de Registro 224501, de 26 de diciembre de2012).
9. Hypercube finalmente vendió el sistema a CONCACAF, que lo utilizó en la fase de clasificación de la Nations League en 2018-19, contactando a MatchVision solo días antes de que se hiciera el sorteo. El sistema seleccionado tenía serios problemas tanto en las áreas técnicas como comunicacionales, que se habrían resuelto si es que MatchVision hubiera sido parte del proceso, y debido al fracaso, CONCACAF no ha vuelto a utilizar el sistema desde entonces.
10. La UEFA conocía el Sistema de Zonas© mucho antes de la propuesta de Erik van Spanje (Ajax) lo propusiera este último tiempo. De hecho, MatchVision ha tenido contactos formales con la UEFA, tanto encuentros cara a cara como en teleconferencias. En dichos encuentros siempre hemos dado a conocer que nuestro formato (Formato de Zonas©), cuenta con Protección Intelectual, incluyendo en correos electrónicos, presentaciones y reuniones en vivo, de las que tenemos pruebas. En todos los casos, se informó a la UEFA de que el formato está debidamente protegido en virtud de los Derechos de Propiedad Intelectual. Algunos de los contactos entre la UEFA y MatchVision son los siguientes:
a. El 17 de junio de 2013, celebramos una reunión cara a cara con Giorgio Marchetti y Lance Kelly en Tel-Aviv, a quienes presentamos específicamente el Sistema de Zonas©.
b. Hemos mantenido conversaciones y teleconferencias con funcionarios del Departamento de Competiciones de la UEFA (Frederic Giroud y Marcelo Alleca), así como con el Director Comercial de la UEFA, Sr. Guy-Laurent Epstein.
c. Con el Presidente de UEFA, Sr. Ceferin, varias veces le hemos explicado cómo funciona el Formato de Zonas©.
d. A través de las reuniones con la UEFA, siempre recibimos la misma respuesta, que UEFA jamás dejaría de utilizar el tradicional formato de grupos, y los conocidos play-off, en sus torneos.
e. También es importante mencionar que, en la reunión en Tel Aviv, el Sr. Marchetti informó que la UEFA estaba trabajando, al menos en ese momento, con la empresa holandesa Hypercube, en relación con consultoría de torneos.
11. Hemos pedido al Sr. Ceferin tres veces en las últimas semanas, tener una reunión sobre este tema, antes del anuncio del uso del Formato de Zonas©. Hasta la fecha, hemos recibido una respuesta formal de la UEFA solamente (25 de febrero de 2021), en nuestras comunicaciones le hemos recordado que el Sistema de Zonas© no se puede utilizar sin la autorización de MatchVision. La respuesta de la UEFA fue que pronto se pondrá en contacto con nosotros, lo que, al día de hoy, aún no ha sucedido.
12. Los documentos filtrados muestran una clara intención de utilizar el Formato de Zonas©, al mismo tiempo, que lo llaman un Formato Suizo, evitando mencionar las múltiples diferencias claras entre ambos sistemas, y el hecho de que la UEFA es plenamente consciente del Sistema Zonas©, al igual que Erik van Spanje, el AFC Ajax, como también ECA.
13. El formato propuesto tiene varios problemas serios en su propuesta no en el formato en sí, porque está siendo propuesto por personas que no han desarrollado el formato, y no tienen los más de 15 años de experiencia que MatchVision tiene con la implementación de estos innovadores sistemas de torneos. Estos defectos inevitablemente dañarán la implementación del nuevo sistema de torneo, y es probable que dañen la reputación tanto de la UEFA como de MatchVision, el desarrollador original y auténtico del formato. Para abordar un ejemplo, el método de desempate es algo que hemos encontrado en nuestros años de investigación y desarrollo, Solución que MatchVision desarrolló para ello, el cual es un sistema de desempate matemáticamente óptimo, también protegido intelectualmente.
14. En el caso de que la UEFA esté genuinamente interesada en utilizar el Sistema de Zonas©, para futuros eventos de la Liga de Campeones, o cualquier otra competición, estamos dispuestos a proporcionar asistencia profesional basada en el pasado en nuestra experiencia de fracasos e implementación exitosa, en diversas competiciones en todo el mundo.
15. Si bien estamos seguros de que la UEFA, basada en su reputación, misión y valores, respetará los derechos de propiedad intelectual, no pondría en peligro su principal torneo, sin embargo, si la UEFA decide seguir adelante con su plan, y continúa utilizando y publicando el término «Formato Suizo» a un formato debidamente registrado, Sistema de Zonas©, MatchVision está dispuesto a tomar las medidas legales necesarias, para garantizar que nuestros derechos internacionales de propiedad intelectual sean protegidos”.

STATEMENT REGARDING POTENTIAL UNAUTHORIZED USAGE OF POT SYSTEM© IN UEFA CHAMPIONS LEAGUE
SANTIAGO DE CHILE, April 16, 2021.- The Chilean mathematician and researcher Leandro Shara, collaborator of the Circle of Sports Journalists of his country and AIPS America, writes to comment that UEFA announces the use of one of its formats that the it is duly protected, in accordance with international conventions that cover these matters. Leandro, President and CEO of MatchVision, has dedicated more than 15 years of his life to the research and development of these mathematical solutions, which ultimately conclude in a competition format. His statement, included in a statement, is as follows:
“Regarding what has been widely commented on social networks and the press, that UEFA will announce the use of a format for the Champions League 2024, which is an unauthorized use and publication of the one of the competition formats developed by Leandro Shara and MatchVision (The Pot System©), we communicate the following:
1. Several press releases, including Martyn Ziegler’s in The Times have written about the proposals for the “shake-up of the UEFA Champions League”, under a wrongly called “Swiss System”, featuring 32 or 36 teams playing 10 matches, without groups, emphasizing the advantage of flexibility given by the format.
2. The real “Swiss System” has been used in Chess for decades and is also widely used today in eSports. Under a Swiss System, the pairing for each round (or ”matchday” in football) is based on previous “matchdays results”, so that competitors would face in each round rivals of their same level.
3. According to the press releases and ECA’s declarations, the proposed format does not contain the features of the authentic Swiss System, as it does not contemplate any intermediate standings and determination of fixtures based on the standings, but instead having pre-defined pairing throughout the first stage.
4. Instead, the proposed format is in fact an implementation of the Pot System© developed, researched, tested, registered, and implemented by Leandro Shara and MatchVision since the year 2006. The system establishes that participants are distributed across pots based on ranking (or other mechanism), so each team plays a pre-defined number of matches against rivals from each pot (for example one match against a rival from each other pot).
5. The biggest benefit of the Pot System© is flexibility, as the number of pots and matches versus teams from each pot can be adjusted to any number of total teams, matches and matchdays required. In 2014 we published an example written in 2014 for EURO qualifiers using different number of pots and matchdays.
6. ECA President, Mr. Andrea Agnelli, explained that such idea came from Ajax CEO, Edwin van der Sar, who proposed this format a year ago under the name “Swiss System”. Later it was discovered that it was Ajax’s Strategic Advisor, Erik van Spanje, that offered this format and called it a “Swiss System” . Mr. van Spanje is a former executive of Dutch consulting company named Hypercube.
7. In February 2016, MatchVision signed a Non-Disclosure Agreement (NDA) with Hypercube, as such company wanted to know in detail the MatchVision format solutions and pursue joint business opportunities. MatchVision shared several case studies and examples of our tournament format solutions.
8. In November 2017, Erik van Spanje and Hypercube shared with us the analysis they have done to the Concacaf regarding the Nations League. In the analysis we saw that Hypercube had offered the Concacaf to use the Pots System© under the misleading name of «Swiss System», without our approval, evidently circumventing the fact that the Pots System© was shared and explained in detail to Hypercube, by MatchVision. This was the first time in history that a format with pre-defined fixtures was called a “Swiss System”, and for the sole purpose of deceiving and avoiding the fact that the Pots System© has Intellectual Protection Rights in the Republic of Chile, based on which global International Intellectual Protection Agreements apply (The System was initially protected on May 17th, 2006, under Registry Number 154857, in Chile, and was supplemented in 2012, under Registry Number 224501, of December 26th, 2012).
9. As we were under an NDA agreement, we could not contact the Concacaf and Hypercube only made the connection between the Concacaf and MatchVision few days before the draw of the Nations League Qualifying Stage. The system selected had serious problems both in the technical and communicational areas, that would have been resolved if MatchVision would have been part of the process – and because of the failure, Concacaf has not used the system again since then.
10. UEFA knew about the Pots System© long before the proposal from Erik van Spanje, Ajax and the ECA. In fact, MatchVision has had formal contacts with UEFA, both face-to-face and teleconference meetings, in which we have made our format known (Pot System ©), including emails, presentations and live meetings, of which we have evidence. In all cases, UEFA was informed that the format is duly protected under Intellectual Property Rights. Some of the contacts between UEFA and MatchVision are the following.
a. On June 17th, 2013, we held a face-to-face meeting with Giorgio Marchetti and Lance Kelly in Tel-Aviv to whom we specifically presented the system.
b. We held conversations / teleconferences with UEFA Competitions Department officials (Frederic Giroud and Marcelo Alleca), as well as UEFA’s Commercial Director, Mr. Guy-Laurent Epstein.
c. We shared by with Mr. Ceferin, several times how the Pot System© works.
d. Across meetings with UEFA, the answer we got to proposals on implementing the Pot System © was a no go: UEFA would not go away from traditional groups and play-off formats in its tournaments.
e. It is also important to mention that, at the meeting in Tel Aviv, Mr. Marchetti informed that UEFA was working, at least at that time, with the Dutch company Hypercube, regarding the modelling of tournaments.
11. We have asked Mr. Ceferin three times in the past weeks to hold the meeting on this subject, before the announcement of this topic. To this date, we have received one formal response from UEFA only (February 25, 2021), upon an e-mail informing and reminding the Pot System© cannot be used without the authorization of MatchVision. UEFA´s response was that they will contact us soon, which, as of today, has not yet happened.
12. The leaked documents show a clear intention of using the Pots System© while calling it a Swiss format, avoiding the multiple clear differences between the systems and the fact that UEFA is fully aware of the Pots System©, as does Erik van Spanje, AFC Ajax and the ECA.
13. The proposed format has several serious issues – again because it is being proposed by people who have not developed the format and do not have the 15+ years of experience MatchVision has with implementing these innovative tournament systems. These flaws will inevitably damage the implementation of the new tournament system and is likely to damage the reputation of both UEFA and MatchVision, the original and authentic developer of the format. To address one example, the tie-breaking method is something we have encountered in our years of R&D and MatchVision developed a solution for it: which is neither a head-to-head nor a goal difference scoring system. MatchVision has developed a mathematically optimal tie-breaking methods, which applies to scenarios when either 1) teams do not directly play against all teams and/or 2) when a single general standing is utilized in tournaments with limited numbers of matches.
14. In the case that UEFA is genuinely interested in using the Pot System© for future Champions League events, or any other competition, we are prepared to provide professional assistance based on past on our fail-and-fix experience and successful implementation across diverse competitions across the world.
15. While we are positive that UEFA, based on its reputation, mission and values, will honor Intellectual Property rights and would not jeopardize its main football competition However, shall UEFA resolves to move forward with its plan and continues to use and publish the term “Swiss Format” to a duly registered format which is the Pots System©, MatchVision is prepared to publicize disclaimers on the issue and take the necessary legal actions to ensure that our international property rights are safeguarded”.
